AUCTION BIDDER DEFAULT:
Default by Buyer: If the Buyer fails to comply with any of the terms and conditions of the auction, including but not limited to failure to pay the earnest money deposit, failure to execute the Contract for Sale of Real Estate, and/or failure to pay the balance of the purchase price on or before the closing date, the Buyer shall be deemed to be in default. - TERMINATION & FORFEITURE OF EARNEST MONEY
Seller may terminate the Contract for Sale of Real Estate immediately upon written notice to Buyer. In such event, the entire earnest money deposit, including any supplemental deposits, shall be forfeited by Buyer and retained pursuant to the terms of the Contract for Sale of Real Estate and applicable Kentucky law. Buyer acknowledges and agrees that actual damages may be difficult to ascertain and that forfeiture of the earnest money deposit is a reasonable remedy and not a penalty. - RESALE OF PROPERTY
Seller and/or Ford Brothers, Inc. may resell the property by public auction, private sale, or any other method deemed appropriate. The defaulting Buyer shall be liable for any deficiency between the original purchase price, including the applicable buyer’s premium, and the resale price obtained, together with all costs, expenses, commissions, attorney fees, advertising expenses, employee labor expenses, and other damages incurred in connection with the resale and enforcement of the agreement. - SPECIFIC PERFORMANCE
Seller may pursue specific performance and require Buyer to complete the purchase and pay the full purchase price pursuant to the Contract for Sale of Real Estate. - AUCTION COMPANY DAMAGES & EXPENSES
Buyer shall remain liable to Ford Brothers, Inc. for all commissions, costs, and expenses incurred in connection with the auction and resale process, including but not limited to advertising costs, surveying costs, engineering costs, employee labor costs, administrative expenses, attorney fees, and any other auction-related expenses resulting from Buyer’s default. - SURVIVAL OF OBLIGATIONS
Buyer’s obligations for damages, costs, expenses, attorney fees, and deficiencies shall survive termination of the Contract for Sale of Real Estate and closing cancellation. - ATTORNEY FEES & COURT COSTS
In the event litigation or legal action is required due to Buyer’s default, Buyer shall be responsible for all court costs, attorney fees, litigation expenses, and collection costs incurred by Seller and/or Ford Brothers, Inc., to the extent permitted by Kentucky law. - GOVERNING LAW & VENUE
All disputes, claims, and legal proceedings arising out of the auction, bidding process, or Contract for Sale of Real Estate shall be governed by the laws of the Commonwealth of Kentucky. Venue for any litigation shall be exclusively in Laurel Circuit Court, Laurel County, Kentucky. - LOSS OF BIDDING PRIVILEGES
Any Buyer determined to be in default may, at the sole discretion of Ford Brothers, Inc., lose all bidding privileges for future Ford Brothers, Inc. auctions and affiliated MarkNet Alliance auctions.
REAL ESTATE TAXES & CLOSING COSTS:
All real estate taxes shall be prorated to the date of closing. Purchaser shall pay all closing costs associated with the purchaser’s side of the transaction, including but not limited to recording fees, lender fees, loan costs, inspections, and financing-related expenses. Any purchases not paid in full by June 16th, 2026 at 6:00 p.m. will automatically be charged to the credit card used at registration. All items must be removed by June 16th, 2026 at 6:00 p.m., and any items not removed by this deadline may, at the discretion of the Auctioneer, be discarded or resold with all proceeds retained by the Auctioneer. Please note, there will be no refunds issued for forfeited items.
Large Item Pickup: Ford Brothers, Inc absolutely DOES NOT provide shipping, shipping preparation, or transportation services for any items larger than the size of the largest U.S. Postal Service flat rate box. Removal of items, moving, packaging, loading, transporting, shipping, and shipping preparation (on items larger than the above-stated size) are the sole responsibility of the purchaser.
Shipping Preparation: Shipping and shipping preparation on items that will fit into a US Postal Service flat rate box will be subject to the following charges: $10 processing and handling fee per box. The buyer shall pay all shipping fees prior to shipping. The shipping insurance is available through most shipping companies and would be the expense of the buyer (optional). Invoice Payment: Any invoice totaling over $1,000 in value, the buyer will be asked to have payment wired to Ford Brothers Inc. Auctioneers, at the auctioneer’s discretion. Wiring instructions will be provided to the buyer upon request.
Item Transportation: Ford Brothers must be notified via phone or email([email protected]) of any items that cannot be picked up on an Auction Pickup day, if we are NOT notified then your items will be forfeited. Any items transported back to a Ford Brothers office/facility are charged a $25 per lot fee ($5 per lot of coin/jewelry). NO GUNS will be transferred between offices due to FFL regulations, you must pick your gun up at the location of the office that conducted the Auction. Items weighing more than 100 pounds or larger than 24 inches x 24 inches x 48 inches will not be shipped or transferred by Ford Brothers to any location. Transported items must be paid for according to the terms of the auction and will be transported at Ford Brothers’ earliest convenience. Buyers MAY NOT waive payment until their items are transported.
Storage of Personal Property Items: Any item stored at a Ford Brothers facility exceeding 48 HOURS will be subject to a $1 per day storage fee.
Forfeiture of Items: Any item/lot that has not been picked up from any Ford Brothers Auction location within 5 business days will, at the Auctioneer's discretion, be discarded or resold with proceeds retained by the Auctioneer.
SALES TAX: Kentucky Sales Tax (6%) will be added to the sale price. Dealers, Agricultural or Resale tax exempt parties seeking to use tax exemption must provide proper documentation to Auctioneer at the time of purchase of said tax exempt products. Buyer shall remain liable to Ford Brothers, Inc. for all commissions, costs, and expenses incurred in connection with the auction and resale process, including but not limited to advertising costs, surveying costs, engineering costs, employee labor costs, administrative expenses, attorney fees, and any other auction-related expenses resulting from Buyer’s default. - SURVIVAL OF OBLIGATIONS
Buyer’s obligations for damages, costs, expenses, attorney fees, and deficiencies shall survive termination of the Contract for Sale of Real Estate and closing cancellation. - ATTORNEY FEES & COURT COSTS
In the event litigation or legal action is required due to Buyer’s default, Buyer shall be responsible for all court costs, attorney fees, litigation expenses, and collection costs incurred by Seller and/or Ford Brothers, Inc., to the extent permitted by Kentucky law. - GOVERNING LAW & VENUE
All disputes, claims, and legal proceedings arising out of the auction, bidding process, or Contract for Sale of Real Estate shall be governed by the laws of the Commonwealth of Kentucky. Venue for any litigation shall be exclusively in Laurel Circuit Court, Laurel County, Kentucky. - LOSS OF BIDDING PRIVILEGES
Any Buyer determined to be in default may, at the sole discretion of Ford Brothers, Inc., lose all bidding privileges for future Ford Brothers, Inc. auctions and affiliated MarkNet Alliance auctions.
REAL ESTATE TAXES & CLOSING COSTS:
All real estate taxes shall be prorated to the date of closing. Purchaser shall pay all closing costs associated with the purchaser’s side of the transaction, including but not limited to recording fees, lender fees, loan costs, inspections, and financing-related expenses. Seller shall pay for deed preparation and deed tax unless otherwise stated.
EASEMENTS:
Subject to any and all easements of record, including but not limited to utility easements, road easements, rights-of-way, and restrictions of record.
ZONING:
This property is subject to all applicable local, state, and federal zoning laws, ordinances, and regulations.
BIDDER VERIFICATION:
The identity of all bidders will be verified. Bidding rights are provisional, and if complete verification is not possible, Ford Brothers, Inc. reserves the right to reject the registration and terminate bidding activity.
The Seller and Ford Brothers, Inc. reserve the right to preclude any person from bidding if there is any question as to the person’s credentials, fitness, financial ability, or eligibility to bid.
Bidders agree to keep their username and password confidential and are responsible for any and all activity involving their account. When using the website, bidders must obey all local, state, and federal laws. Violations will result in termination of website use privileges.
AGENCY:
Ford Brothers, Inc., its agents, and representatives are acting solely as agents of the Seller.
Buyer and/or Bidder agrees to indemnify and hold harmless Ford Brothers, Inc., its agents, representatives, officers, employees, and the Seller from any and all claims, damages, liabilities, lawsuits, judgments, costs, expenses, or fees arising out of or related to the auction, bidding process, or sale of the property, to the extent permitted by Kentucky law.

PERSONAL PROPERTY TERMS:
Auction Premium: There will be a 10% Auction Premium added to the winning bid. The sum of the winning bid plus the Auction Premium will be the sales price.
Online Auction Ending Times:
Ford Brothers, Inc. Online Auctions are timed events and all bidding will close at specified time. Ford Brothers, Inc. Real Estate Online Auctions also have an auto extend feature. If a bid is placed in the final 5 minutes of an auction, the auction ending time will be automatically be reset back to the 5 minutes remaining mark.. Example: if an auction scheduled to close at 6:00 receives a bid at 5:59, the close time will automatically be reset back to 5 minutes. The auto extend feature remains active until no further bids are received within a 5 minute time frame.
Staggered Closing: This online auction closes in intervals. Depending on how large (# of lots) an auction is, then we set the auction to close so many lots at a time. It is typically 20-50 lots every minutes. If it is a large auction then it will be 75-100 lots at a time. Please monitor the countdown timer to see when the lot will close. Please check the auction announcements for detailed information regarding these intervals. This feature works great with the auto-extend feature to closely emulate a live auction.
SERVER & SOFTWARE TECHNICAL ISSUES: In the event, there are technical difficulties related to the server, software, or any other online auction-related technologies, Ford Brothers, Inc. reserves the right to extend bidding, continue the bidding, or close the bidding. NEITHER THE COMPANY PROVIDING THE SOFTWARE nor FORD BROTHERS, INC. SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. Email notifications will be sent to registered bidders with updated information as deemed necessary by Ford Brothers, Inc.
All personal property is sold in “AS IS” and “WHERE IS” condition. ALL SALES ARE FINAL! Bidder understands and agrees that no refunds, exchanges, adjustments, chargebacks, etc, will be allowed. The personal property is available for inspection at specified times and it is the bidder's responsibility to determine the condition. Payment, Pickup, Shipping & Storage Terms:
Pickup/Payment Info: Pickup will be available on June 16th, 2026 from 12:00 noon until 6:00 p.m. Accepted forms of payment include cash, cashier’s check, personal or business check, Visa, Mastercard, American Express, Discover, or wire transfer; however, all purchases exceeding $500 must be paid by cash, cashier’s check, personal or business check, or wire transfer, with any wire transfer fees being the responsibility of the purchaser. Any purchases not paid in full by June 16th, 2026 at 6:00 p.m. will automatically be charged to the credit card used at registration. All items must be removed by June 16th, 2026 at 6:00 p.m., and any items not removed by this deadline may, at the discretion of the Auctioneer, be discarded or resold with all proceeds retained by the Auctioneer. Please note, there will be no refunds issued for forfeited items.
Large Item Pickup: Ford Brothers, Inc absolutely DOES NOT provide shipping, shipping preparation, or transportation services for any items larger than the size of the largest U.S. Postal Service flat rate box. Removal of items, moving, packaging, loading, transporting, shipping, and shipping preparation (on items larger than the above-stated size) are the sole responsibility of the purchaser.
Shipping Preparation: Shipping and shipping preparation on items that will fit into a US Postal Service flat rate box will be subject to the following charges: $10 processing and handling fee per box. The buyer shall pay all shipping fees prior to shipping. The shipping insurance is available through most shipping companies and would be the expense of the buyer (optional). Ford Brothers, Inc. and the sellers WILL NOT be liable for any lost or damaged packages.
Invoice Payment: Any invoice totaling over $1,000 in value, the buyer will be asked to have payment wired to Ford Brothers Inc. Auctioneers, at the auctioneer’s discretion. Wiring instructions will be provided to the buyer upon request.
Item Transportation: Ford Brothers must be notified via phone or email([email protected]) of any items that cannot be picked up on an Auction Pickup day, if we are NOT notified then your items will be forfeited. Any items transported back to a Ford Brothers office/facility are charged a $25 per lot fee ($5 per lot of coin/jewelry). NO GUNS will be transferred between offices due to FFL regulations, you must pick your gun up at the location of the office that conducted the Auction. Items weighing more than 100 pounds or larger than 24 inches x 24 inches x 48 inches will not be shipped or transferred by Ford Brothers to any location. Transported items must be paid for according to the terms of the auction and will be transported at Ford Brothers’ earliest convenience. Buyers MAY NOT waive payment until their items are transported.
Storage of Personal Property Items: Any item stored at a Ford Brothers facility exceeding 48 HOURS will be subject to a $1 per day storage fee.
Forfeiture of Items: Any item/lot that has not been picked up from any Ford Brothers Auction location within 5 business days will, at the Auctioneer's discretion, be discarded or resold with proceeds retained by the Auctioneer.
SALES TAX: Kentucky Sales Tax (6%) will be added to the sale price. Dealers, Agricultural or Resale tax exempt parties seeking to use tax exemption must provide proper documentation to Auctioneer at the time of purchase of said tax exempt products. All products or items be deemed acceptable and/or eligible for tax exemptions.
Any dispute between Ford Brothers, Inc, its Agents or Representatives, and the Buyer(s) will be tried in a court of jurisdiction in Laurel County, Kentucky. By bidding on the property, the buyer agrees to all terms and conditions set forth.
Agency: Ford Brothers, Inc.' Agents and Representatives are agents of the Seller. Buyer and or Bidder agrees to hold harmless and indemnify Ford Brothers, Inc. and its Agents and its Representatives from any and all claims, damages, or suits including but not limited to awards, judgments, costs, fees, etc.
Ford Brothers, Inc., reserves the right to alter this agreement at any time. This will take place by updating this site. Please check back and review these terms as every time you use this site you are agreeing to the terms as they are written at that time.
Auction company employees and/or the auction company may bid on and purchase auction items.
BIDDER DEFAULT: Failure to complete a purchase is illegal and will result in one or more of the following (1) prosecution (2) a $5,000 penalty (3) loss of bidding privileges for Ford Brothers and all other MarkNet auctions.
If a bidder at any time feels his/her username, password, or bidder number has been compromised due to lack of security by the bidder, notify Auctioneer immediately.
