TERMS:
Auction Premium: There will be a 10% Auction Premium added to the winning bid. The sum of the winning bid plus the Auction Premium shall constitute the total purchase price. Example: Bid Price of $100,000 plus $10,000 (10% Buyer’s Premium) equals a total purchase price of $110,000.
AUCTION TIMES:

If a bid is placed within the final five (5) minutes of an auction, the auction ending time will automatically extend five (5) minutes from the time the bid was placed. Email notifications may be sent to registered bidders with updated information as deemed necessary by Ford Brothers, Inc.

BUILDINGS & IMPROVEMENTS TO BE REMOVED:
The improvements offered in this auction are being sold separately from the underlying real estate. Purchaser acknowledges that this auction conveys ownership only of the improvements specifically identified in the auction advertisement. No ownership interest in the underlying real estate, mineral rights, easements, utilities, access rights, or any other interest in the real property is being conveyed.
Successful in-person/live bidders shall be required to pay the purchase price immediately following the conclusion of the auction. Successful online bidders shall be required to remit payment within forty-eight (48) business hours following the conclusion of the auction in the form of cash, certified check, cashier's check, or wire transfer. Business hours shall exclude weekends and federal holidays. Purchasers are expected to communicate promptly with Ford Brothers, Inc. following the auction regarding payment arrangements. Failure to communicate or cooperate with Ford Brothers, Inc. regarding payment requirements may be considered evidence of default. Purchaser shall be responsible for all wire transfer fees.
Upon receipt of full payment, ownership of the purchased improvements shall transfer to the Purchaser. Seller shall deliver any available ownership documentation, including mobile home title documents, if applicable. Seller and Ford Brothers, Inc. make no warranty regarding the availability, status, transferability, or condition of any title documents unless specifically stated in the auction advertisement.
Purchaser shall have sixty (60) calendar days following the auction, unless otherwise announced in writing, to completely remove all purchased improvements from the property. Time is of the essence regarding all payment obligations, removal requirements, cleanup obligations, and removal deadlines.
The purchased improvements are sold "AS IS, WHERE IS" and shall remain at the Purchaser's sole risk after payment has been received. Purchaser assumes all responsibility for the improvements, including any loss or damage caused by weather, fire, theft, vandalism, collapse, acts of God, or any other cause occurring after payment and prior to removal.
REMOVAL OF IMPROVEMENTS:
Purchaser shall be solely responsible for all labor, equipment, permits, engineering, transportation, utility disconnections, inspections, contractors, moving expenses, demolition (if required), and all costs associated with removing the purchased improvements from the property. Purchaser shall comply with all applicable federal, state, and local laws, regulations, permitting requirements, and transportation requirements. Removal activities shall be coordinated with the Seller and/or Ford Brothers, Inc. and shall occur only during reasonable hours unless otherwise approved. Seller reserves the right to temporarily suspend removal operations due to unsafe conditions, weather, farming operations, livestock, emergencies, or other reasonable circumstances.
Prior to entering the property, Purchaser shall be responsible for ensuring that all contractors performing removal work maintain appropriate liability insurance. Upon request, Purchaser shall provide Ford Brothers, Inc. with the contractor's name, contact information, and proof of insurance. Seller and Ford Brothers, Inc. reserve the right to deny access to any contractor who cannot demonstrate adequate insurance coverage.
PROPERTY DAMAGE & SITE RESTORATION:
Purchaser shall exercise reasonable care while removing the purchased improvements. Purchaser shall be solely responsible for any damage caused by Purchaser, Purchaser's employees, contractors, movers, or agents during the removal process. This includes, but is not limited to, damage to driveways, culverts, roads, gates, fences, fields, drainage systems, septic systems, utility lines, water lines, crops, trees, landscaping, or any remaining improvements located on the property.
Following removal, Purchaser shall remove all concrete blocks, tie-downs, anchors, skirting, debris, trash, personal property, steps, porches (unless otherwise stated), and all materials associated with the improvements. The site shall be left in a reasonably clean, safe, and level condition to the reasonable satisfaction of the Seller. Any restoration or cleanup costs incurred by the Seller due to Purchaser's failure to comply with these requirements shall be the responsibility of the Purchaser.
ACCEPTANCE OF BID PRICES:
Successful bidder(s) will be required to enter into a Contract for Sale of Real Estate immediately following the close of the auction. Ford Brothers, Inc. will email documents to be executed, and said documents must be returned to Ford Brothers, Inc. within forty-eight (48) hours following the conclusion of the auction.

Buyer acknowledges and agrees that actual damages may be difficult to ascertain and that forfeiture of the earnest money deposit is a reasonable remedy and not a penalty. - RESALE OF PROPERTY
Seller and/or Ford Brothers, Inc. may resell the purchased improvements by public auction, private sale, negotiated sale, demolition, salvage, or any other method deemed appropriate. If the improvements are not removed within the required removal period, Seller may remove, demolish, dispose of, or otherwise retain the improvements without further notice to the Purchaser. The defaulting Purchaser shall remain liable for any deficiency between the original purchase price, including the applicable Buyer's Premium, and any resale proceeds, together with all attorney fees, labor costs, advertising expenses, contractor charges, demolition costs, transportation expenses, cleanup costs, restoration costs, storage expenses, commissions, and any other damages incurred as a result of the Purchaser's default. - SPECIFIC PERFORMANCE
